Terms and conditions

These terms and conditions are governed by the laws of New South Wales, Australia and you hereby irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of that state.

On this website:

“Additional Rules” means any additional rules or guidelines that we determine to apply to particular events or aspects of this website, such as competitions or special promotions;

“Loss” means any loss, damage, cost, claim or expense;

“Terms and Conditions” means these terms and conditions of use (as varied by us from time to time) and includes any Additional Rules;

“we” and “us” means Autism Understanding Pty Ltd (ABN 68 164 519 608) of New South Wales, Australia, trading as Autism Understanding;

and “website” means the whole or any part of our websites located at autismunderstanding.com.au, members.autismunderstanding.com.au, shop.autismunderstanding.com.au and its connected course and program delivery software.

By continuing with your purchase, download or subscribe you are hereby agreeing to these terms and conditions of sale in conjunction with the terms of our Privacy Policy.

  1. Online Payments

    1. All transactions are processed in Australian Dollars (AUD $).
    2. 10% GST applies to all Australian residents.
    3. We use Stripe for handling our online payments and your credit card number will be protected with a high level of encryption when transmitted over the internet.
    4. Autism Understanding will not have access to your credit card details, even when stored securely for recurring billing services.
    5. We currently do not accept payments in:
      1. other currencies;
      2. cash;
      3. cheque;
      4. bank transfer;
      5. paypal.
    6. Upon successful payment processing we will send you a tax receipt/invoice email confirmation of your payment.
    7. Payments are debited to Autism Understanding Pty Ltd.
    8. If your payment is unsuccessful, Autism Understanding Pty Ltd will not be advised why the payment has failed, therefore, you should contact your credit card provider for details. If your payment fails, please use one of the other payment methods described on your payment email link. Please arrange an alternative payment method promptly to ensure you do not lose access to your purchased items.
    9. Subscription and instalment payments are automatically debited from your card on file via Stripe. 
    10. Failure to pay subscription or instalment payments by the due date will result in loss of access to your purchased item/s. 
  2. Event Booking Terms

    1. 'Event' and 'Events' refer to any live, virtual or recorded Event, Training, Workshop, Webinar.
    2. There is a 14 day cancellation notice for any training bookings regardless of payment being received.
    3. Refunds are given if over 14 days notice is given, less a $50 administration fee. 
    4. 50% refund is given for cancellation received 7-14days prior to the event.
    5. Refunds do not apply for bookings cancelled within 7 days of the event.
    6. A minimum of 3 people are required to book in for the event to go ahead.
    7. Bookings will be fully refunded or transferred to other dates if event dates need to be changed by the event organiser.
    8. If events need to be cancelled due to restrictions for COVID-19, then participants have the option of attending the online live event, complete the self-paced online course or a full refund issued.
    9. Any event bookings that have been won as part of a giveaway or transferred as a gift are not eligible for refund nor redeemable for cash.
    10. Event bookings are not permitted to be sold or bartered to a third-party by the original winner without written permission from us.
    11. We reserve the right to amend or update event offer details and inclusions at any time, and without notice.
    12. Close of cart dates (end of purchase period) and special offer promotional dates are final and we are not obliged to offer the discount or special offer for any individual after the end of the promotional period.
  3. Digital Products & Courses Terms

    1. 'Digital Product/s' refers to any digital resources, downloads, e-books, videos, documents, courses, or digital community access.
    2. Refunds do not apply to the purchase of digital products due to the nature and instant delivery of the product, unless required by Australian Law.
    3. Any digital products that have been won as part of a giveaway or transferred as a gift are not eligible for refund nor redeemable for cash.
    4. Digital products and courses are not permitted to be sold or bartered to a third-party by the original winner without written permission from us.
    5. We reserve the right to amend or update offer details and inclusions at any time, and without notice.
    6. Close of cart dates (end of purchase period) and special offer promotional dates are final and we are not obliged to offer the discount or special offer for any individual after the end of the promotional period.
    7. Online course access will be available for a minimum of 12 months. Access after 12 months is not guaranteed.
  4. Retreat Terms

    1. Retreat bookings are only open to registered and provisional psychologists. 
    2. Spaces are sold on a first-in, first-served basis
    3. Bookings close as soon as all spaces are sold out.
    4. Booking fee includes:
      1. Accommodation for duration of the retreat.
      2. Professional Development Workshops at the retreat.
      3. Main meals, morning tea and afternoon tea.
    5. Booking fee does not include:
      1. flights
      2. transfers
      3. alcohol or additional meals
      4. any anything else not specified in clause 4.
    6. Attendees are required to be on-site for a 2pm commencement on day one, and leave the venue before 1pm on Day 3.
    7. Spaces are strictly limited to 20 attendees, plus event host.
    8. Retreat Cancellation, Transfers & Refunds
      1. Full refunds are given if more than 30 days notice of cancellation is given, less a $50 administration fee.
      2. Cancellation received 14-30 days prior to the retreat is eligible for a 50% refund, or, 100% of paid fees are transferred as credit towards a future retreat booking, online group supervision, or private supervision.
      3. Cancellation received <14 days prior to the retreat is not eligible for a refund. 100% of paid fees are transferred as credit towards a future retreat booking, online group supervision, or private supervision.
      4. If you cannot attend due to illness, COVID-19, or serious unforeseen circumstances then you may be provided the option of transferring your retreat payment as credit towards the next retreat, or as credit towards private or group supervision.
      5. For the safety of other attendees, if you are unwell or test positive to COVID-19 within 7 days of the retreat event, or during the retreat, you must notify us and cancel your attendance. 
      6. No cash refunds will be given for bookings cancelled within 14 days of the retreat.
      7. In the event that the organiser needs to postpone the retreat, all bookings will be fully refunded or transferred as credit to a future retreat, online group supervision, or private supervision.
      8. Upon cancellation, any due payments must be paid in full within 7 days of cancellation. 
      9. Retreat bookings are transferrable only with written permission from the retreat organiser. A minimum of 7 days notice is required.
      10. Any retreat bookings that have been won as part of a giveaway or transferred as a gift are not eligible for refund nor redeemable for cash.
      11. Retreat tickets are not permitted to be sold or bartered to a third-party by the original winner without written permission from us.
    9. We reserve the right to amend or update the retreat offer details and inclusions at any time, and without notice.
    10. Close of cart dates (end of purchase period) and special offer promotional dates are final and we are not obliged to offer the discount or special offer for any individual after the end of the promotional period.
    11. Retreat pricing, locations, training topics and inclusions will vary for each event. Current retreat details are not indicative of future event details.
    12. Autism Understanding retains the copyright in all materials created, provided and shared on retreat. Please request written permission to re-use or share any resources provided. 
  5. Physical Items

    1. For physical products, shipping is included in the price for Australian customers only. International customers must request from us, and confirm acceptance of, a shipping quote prior to shipment of goods to an international address.
    2. In respect of physical items, we will provide you with a refund or offer you an exchange where the product is faulty or not fit for the purpose for which goods of that kind are commonly bought; and the product does not match the sample or description advertised on this website.
    3. Please send back to us the defective goods within seven (7) days of receiving them, along with the following details:
      1. Your name and address;
      2. Original order number; and
      3. The reason for the return of the goods.
    4. We reserve the right to assess the condition and age of all returned goods prior to offering a refund or exchange. This may result in a refund or exchange being refused.
    5. You will be entitled to a refund equal to the cost of the product only and you will incur the charges of the delivery and return of the product. If you are entitled to a refund, the refund will be made upon your return of the product.
    6. We recommend that all returns be sent to us via Registered Mail or Courier. You will be solely responsible for any lost returns.
    7. Any products that have been won as part of a giveaway or transferred as a gift are not eligible for refund nor redeemable for cash.
    8. Products are not permitted to be sold or bartered to a third-party by the original winner without written permission from us.

  6. Membership (Neurodiversity-Affirming Clinician)

    1. Access:
      1. Subscription payment provides 12-month access, with annual renewal. 
      2. You may not share access to the Members Area, or its included content, with any other person who is not a paid member. 
      3. You are prohibited from sharing your login details with others. 
      4. If you are found to be sharing access and resources with non-paying members, your access will be terminated immediately, without notice. 
    2. We reserve the right to:
      1. change pricing and terms of membership at any time, without notice.
      2. add or remove resources, events and videos at any time, without notice. 
    3. Included Training & Resources
      1. You may access the member's site and its included resources at any time, from anywhere.
      2. All webinars and discussion sessions offered to members are recorded. If you wish to remain anonymous and not be recorded, you are responsible for removing your display name on Zoom, and turning off your audio and video, to avoid being identifiable during the session. 
      3. Sensitive information may be shared in the group, it is a condition of entry that this will be respected with total confidentiality. A breach of this term may result in serious action including expulsion and legal ramifications.
      4. You understand that anything you share in the member trainings, discussion calls, or forum, is available for other current and future members to watch or read. You are responsible for redacting any personal or identifiable client information that cannot be shared in this professional space. Please consider deleting highly personal content after 1 month.
      5. Failure to attend a live webinar or Q&A session is not grounds for a refund. Recordings of all training and discussion sessions offered to members are optional for attendance, recordings are made available to all members.
      6. CPD Certificates are provided for individual training modules within the member's area. Complete as many modules as you wish. 
      7. Autism Understanding retains the copyright to all provided media, resources, videos, training protocols, examples, case studies, and documents. You may not rebrand, distribute, or sell any of the provided materials.
    4. Cancellation
      1. You can cancel your membership subscription at any time.
      2. Cancelling your membership retains your access for the remainder of your pre-paid year of access, but will not renew access for the subsequent year.
      3. At the time of cancellation, you will be liable for any outstanding payments for the year (if unpaid) and will only retain your access if your payments for the year are paid. This applies to instalment billing plans. 
      4. Member access in subsequent years is offered at a lower recurring subscription fee per year, if you cancel your membership and rejoin at a later date you will be joining at whatever the current advertised membership fees are, and you will not be eligible for the plan you cancelled. 
      5. Once your account is cancelled you will lose access to the NAC membership site, certificates, resources, modules, etc. Before your cancellation date, we recommend that you download what you need before this date as it is not available after your cancellation date. 
      6. If a live member event that you have opted in to attend as a member, falls after your cancellation date, you will be removed from this event and unable to attend unless you pay for access to that particular webinar. 
    5. Refunds
      1. Due to receiving instant access to digital training and resources, refunds are not available.
      2. You will not be eligible for any refund if your access and membership are terminated by us due to your misconduct.
      3. If you are experiencing financial hardship, a customised payment plan or subscription pause may be available to you. Contact us to discuss options. 
    6. Misconduct in the Membership
      1. We do not tolerate misconduct in the member's area, on our training calls, or with the use of our provided resources and training materials. 
      2. Misconduct of any kind will result in immediate termination of your account and access.
      3. What we class as misconduct:
        1. Fraud (financial, professional, CPD, IP etc);
        2. Hate speech;
        3. Sharing private and personal information of individuals without their consent;
        4. Breach of copyright;
        5. Sharing access to training portal and resources with others;
        6. Racism;
        7. Verbal or emotional abuse;
        8. Privacy or security breach;
        9. Publicly harassing or speaking negatively about our company, any of our team members, or other NAC members.
  7. Certification / CPD Points

    1. Certificate of attendance, Certificate of Completion, CPE/CPD points (and similar provisions) are only provided to participants who:
      1. attend the full duration of the event, webinar, course or retreat;
      2. have demonstrated engagement in the online learning material (we can assess time spent on modules, modules marked complete);
      3. have submitted and passed any required assessments by the allocated due dates.
    2. We will not provide a Certificate of attendance, Certificate of Completion, or CPE/CPD points for just purchasing a ticket to an event, or retreat, or buying access to an online course.
    3. Completion of any of our training events does not provide you with any accredited qualifications.
  8. Offers with Applications

    1. Some programs, events and offers are open by application only. Acceptance is not guaranteed.
    2. Applications received outside of the application dates will not be accepted. 
    3. While we do all we can to ensure appropriate connection at all times, we are not liable for not receiving your application or order emails which results in missing a place in the advertised program, course, or event.
  9. Confidentiality

    1. You agree to keep details of all sessions, strategies and plans, content, ideas, passwords, logins, client information, and associated data that is shared with your purchase confidential at all times.
    2. We are committed to the utmost confidentiality. All information (written, audio, video, verbal, graphic) that you share with us, and vice-versa, as part of your purchase and/or participation in events, will be kept confidential unless disclosure is required for staff, external parties or sub-contractors to fulfil services, or if required by law (such as fear for your or another person’s safety or through a court order or subpoena).
    3. While we will do our best to maintain the security and confidentiality of all information shared, we take no responsibility for the security of information shared via third-party applications such as email providers, the websites or social media platforms which may be accessible to third parties.
    4. If sessions are recorded, we will inform you of this fact. The recordings must not be made public or shared with anyone not participating in the event, in any way, at any time.
    5. You are not permitted to screenshot, copy, broadcast or share details of sessions, events, resources, or course material. 
    6. Photos and videos of live events can be taken, however, they may not be posted on social media if there are other participants in the photo or video, unless they have permitted you to share their image publicly.
    7. You must not share with any third party any personal logins or access to documentation provided by us without written consent.
    8. Any participant found to be broadcasting or sharing access to any part of any paid service, course, program or product with a third party that has not paid for access will have their access immediately removed and will be liable for damages.
    9. Sensitive information may be shared in group sessions or webinars, it is a condition of entry that this will be respected with total confidentiality. A breach of this term may result in serious action including expulsion and legal ramifications.
  10. Intellectual Property

    1. We do not permit public or commercial use of any materials, recordings and content created and published by us without prior written consent.
    2. Duplication of any part of the materials, recordings and content created by us is strictly prohibited without prior written consent.
    3. All materials are subject to copyright and all rights are reserved by us.
    4. Any breach of copyright will result in prosecution.
  11. Disclaimer

    1. We make no guarantees with any of the products or services sold and do not warrant or guarantee specific commercial outcomes.
    2. You accept that given the nature of the products and services provided by us, the results experienced by every participant will differ. You accept responsibility for any such variance.
